TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) together with our Privacy Policy govern your use of the The Home Beauty Edit website and your relationship with The Home Beauty Edit (“we” or “us”) and set out the legal terms and conditions on which we sell any of our products to you. Please read these Terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these Terms, please contact us to discuss.

If you do not agree to these Terms, please do not register for or use the The Home Beauty Edit website. By ordering any of our products you agree to be bound by these Terms. Nothing in these Terms affects your statutory rights.

We amend these Terms from time to time. Each time you wish to order products please check these Terms to ensure you understand the Terms which will apply at that time.

Every time you order products the Terms in force at that time will apply to the contract between us.

These Terms were last changed on 28th May 2020.

HOW WE MAY CONTACT YOU

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

“Writing” includes emails. When we use the words “writing” or “written” in these Terms, this includes emails.

SHOPPING WITH THE HOME BEAUTY EDIT

You can order products online via this website only.

When you place an order for a product in any of the ways described above you are offering to buy it for the price stated, subject to these Terms.

When you place your order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order and all orders are subject to availability. Once we have sent the confirmation email we will then check availability and if the product is not available we will contact you by email and will not process your order.  Your order (including payment) is an offer to buy from us, so nothing we do or say will amount to any acceptance of that offer until we actually send the product to you. You must pay for products before we dispatch them.

If we are unable to accept your order we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock or discontinued (which may happen at any time), because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline. If you have already paid for the products we will refund you the full amount as soon as possible. This does not affect your Statutory Rights.

The images of the products on our website are for illustrative purposes only.

Please note that the packaging of our products may vary from images on our website.

OUR RIGHTS TO MAKE CHANGES

We may change the product to reflect changes in relevant laws and regulatory requirements.

We may update these Terms from time to time and these changes will apply to the use of The Home Beauty Edit website and any orders you place on the website after the Terms are updated.  If you do not wish to accept the new Terms you should not continue to use The Home Beauty Edit website. If you continue to use The Home Beauty Edit website after the date on which the change comes into effect, your use of The Home Beauty Edit website indicates your agreement to be bound by the new Terms.

PRICE

The price for each product will be displayed on the order pages where you place your order and is shown UK sterling and includes VAT at the applicable rate chargeable in the UK for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.

We always try to make sure that the prices on The Home Beauty Edit website are accurate but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your order at the correct price or cancelling it. (If we are unable to reach you, we will treat the order as cancelled). If an order is cancelled, any payment made for the products will be refunded in full. Prices for our products may change from time to time but changes will not affect any order which has been dispatched or for which we have issued a dispatch confirmation. Please note that if a pricing error is obvious and unmistakable and could have reasonably been recognised by you as a mispricing then we may cancel your order, refund you any sums you have paid and require a return of any products provided to you.

You will be notified of the delivery costs automatically before you submit your credit or debit card details, based on the delivery address you specify.

PAYMENT

Orders may be processed online, using a credit or debit card (Visa and Mastercard Credit Cards, Visa Debit). To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet. Payment for the products and all applicable delivery charges is in advance of dispatch.

SECURITY

We use Shop Pay by Shopify a company with the latest security measures to protect your details when you shop with us.

No personal or financial details are left unencrypted on a remote server, and such details are never sent by internet email.

Your credit card company may also do security checks to confirm it is you making the order.

All order details and invoices will be sent with your goods to the delivery address that you specify at the point of placing your order.

DELIVERY

Delivery is free of charge on all orders. Orders placed before 11:30am should be delivered within 2 working days between the hours of 8am and 6pm.

No orders are processed, dispatched, or delivered on Bank Holidays or weekends.

Please note that you do not need to sign for your delivery upon receipt, but goods are tracked to ensure that we are aware of when they are delivered. If you would like your delivery left in a safe place, please leave a comment at checkout.

Any dates or times quoted for delivery are approximate only and you acknowledge that no delivery date can be guaranteed as it may be affected by circumstances beyond our control.

During sale period please expect deliveries to take up to 7 working days.

DELIVERY AND CHARGES

All orders will be delivered within 30 days after the day on which we accept your order. No orders are processed, dispatched, or delivered on Bank Holidays or weekends. For detailed info on Delivery of Goods and Postcode Exceptions see below.

THE HOME BEAUTY EDIT DELIVERS TO THE UK ONLY

Please note that The Home Beauty Edit is NOT permitted to deliver goods to The Republic of Ireland.

We are unable to deliver to PO Box or BFPO addresses.

Any costs of packing and any applicable delivery charges are clearly displayed at the checkout for your approval prior to confirming your order.

OTHER POSTCODE EXCEPTIONS:

HS, KW, ZE, IV – delivery times may vary to these postcodes

RETURNS

We believe that you will be thrilled with the products you purchase but understand that there may be an occasion where you feel it necessary to return an item. As part of our commitment to customer service, we aim to keep these instances to a minimum and the process as simple as possible.

FAULTY / INCORRECT GOODS:

As a consumer you have legal rights in relation to products which are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect those legal rights.

If you receive an item from us which is faulty/broken or which you did not order, please contact us by telephone on 023 8046 0600 or email us at coty.cs@paulmurrayplc.co.uk to inform us within 28 days of purchase and we will arrange a refund where applicable including any applicable delivery charges or a replacement. In the event of you returning goods to us, please contact us prior to returning the items as we will arrange for our delivery partner to collect the goods from you, you do not need to print a returns label.

Returned goods will need to be:

  • Accompanied by your proof of purchase (i.e. online order confirmation, dispatch e-mail or dispatch note)
  • In the original packaging and/or with the original tags attached
  • Unopened and in an unused condition.

Refunds will be processed within 14 days of receipt of goods, which will be inspected within 72 hours of receipt.

For hygiene reasons we do not accept exchanges or refunds unless the products are defective or faulty.

Please note that if you choose to return the item/s to us without using our returns paid process we will be unable to refund your postage fees.

If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

If no one is available at your address to take delivery and the products cannot be posted through your letterbox or left in a safe place, we will leave you a note and we will attempt to re-deliver the following day.

If, despite our reasonable efforts, we are unable to deliver and unable to contact you or re-arrange delivery or collection we may end the contract and refund any money you have paid in advance.

A product will be your responsibility from the time we deliver the product to the address you gave us.

You own a product once we have received payment in full.

UNWANTED GOODS

If you are a consumer you have a legal right to cancel a contract during the period set out below. This means that during the relevant period if you change your mind or for any other reason decide you do not want to keep a product you can notify us of your decision to cancel the contract between us and receive a refund. Please note that this only applies to unopened and unused products. Advice about your legal rights to cancel the contract is available from your local Citizens’ Advice Bureau or Trading Standards office.

Your legal right to cancel the contract between us starts from the date we send you a dispatch confirmation which is when the contract between us is formed. If the products have already been delivered to you, you have a period of fourteen (14) working days in which you may cancel, starting from the day after the day you receive the products. Working days means that Saturdays, Sundays and public holidays are not included in this period.

If you choose to cancel the contract we will refund you any money (including any delivery charges) which you have paid us for that product. We will process the refund due to you as soon as possible and in any event within 30 calendar days of the day on which you gave us notice of cancellation. In order to cancel the contract please contact us by telephone on 023 8046 0600 or email us at coty.cs@paulmurrayplc.co.uk to inform us that you wish to return the goods. We will arrange a collection of your goods. To enable us to deal with your return as efficiently as possible, you will need to include your invoice/receipt with the package of returned goods. For faulty goods or goods which were inaccurately described or incorrect please see below.

We will refund you on the credit card or debit card used by you to pay.

COMPLAINTS

We welcome all feedback about our service and we aim to deal with any problems or difficulties experienced by our customers both quickly and fairly. We have a simple but comprehensive returns and refunds policy which means that we can get to the bottom of most queries quickly and easily over the phone or by email. For issues that cannot be dealt with immediately we will endeavour to respond within 24 hours either with a solution or with an expected timescale to put an end to the issue. AVAILABILITY OF PRODUCTS

We try to keep The Home Beauty Edit website as up to date as possible but cannot guarantee that a particular product will always be available.

All offers are available while stocks last. If we are unable to supply a product you have ordered, we will notify you as soon as we can after receiving your order. If this happens, you may cancel your order and we will refund you the money you have paid for it.

We try and offer you the best service we can. But we cannot promise that all our products and services will meet your requirements and we cannot guarantee that The Home Beauty Edit website will be fault free. If you find a fault, please let us know by emailing.

There will be some times when your access to The Home Beauty Edit website is restricted to allow for repairs, maintenance or improvements.

LIABILITY OF THE HOME BEAUTY EDIT

The Home Beauty Edit website is provided by us without any warranties or guarantees. You must bear the risks associated with the use of the Internet. If we are informed of any inaccuracies in the material on The Home Beauty Edit website we will try to correct them as soon as we can.

In particular we are not liable to you for the following:

  1. Incompatibility of The Home Beauty Edit website with any of your computer or telecommunications equipment or software
  2. Technical problems or errors or interruptions of The Home Beauty Edit website
  3. Inadequacy of The Home Beauty Edit website to meet your requirements
  4. To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (included but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss or privacy or loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related The Home Beauty Edit website

Nothing in the above paragraph applies to liability in respect of products sold through The Home Beauty Edit website.

If we fail to comply with these Terms we are responsible for loss or damage that you suffer that is a foreseeable result of our breach of these Terms or our negligence but we are not responsible for any damage which is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we entered into the contract.

We only supply the products to you for domestic and private use. You agree not to use the products for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products including the right to receive products which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; and for defective products under the Consumer Protection

Act 1987 PROPRIETARY RIGHTS

The content of The Home Beauty Edit website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of The Home Beauty Edit website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on The Home Beauty Edit website without written permission from us.

No license is granted to you in these Terms to use any trademark or service marks of Coty UK&I or its licensors including, without limitation, the trade marks, or service marks.

GENERAL

Please read the instructions, manuals and other user documentation that comes with your Products carefully. You are urged to use all Products safely and in accordance with the guidelines.

We may change or withdraw any part of The Home Beauty Edit website, or may refuse you access to the web site at any time if we consider it necessary.

We may also immediately remove, cancel or suspend access to and use of The Home Beauty Edit website upon breach of any part of these Terms whatsoever. This shall be without prejudice to The Home Beauty Edit’s other rights.

We may transfer our rights and obligations under a contract with you to another organisation, but this will not affect your rights or our obligations under these Terms.

We act as principal on our own account and not as agent for you or any other person.

If we do not enforce any provision of these Terms such will not be considered a continuing waiver.

In the event that any part of these Terms is held to be unenforceable, such part will at our option be construed as far as possible to reflect the parties’ intentions and the remainder of the provisions will remain in full force and effect.

This contract is between you and us. No other person shall have any rights to enforce any of its terms.

These Terms constitute the full agreement between you and The Home Beauty Edit and may only be amended in writing. They apply to the exclusion of all other terms or conditions of contract proposed.

Our website is solely for the promotion of our products in the UK. Unfortunately, we do not accept orders from or deliver to addresses outside the UK. Since we only operate within the UK market, we cannot guarantee that our website accords with local laws of any other countries.

Use of The Home Beauty Edit and these terms are subject to the laws of England & Wales and the jurisdiction of the English Courts. This means a contract for the purchase of products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

YOUR RIGHTS TO END THE CONTRACT

Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing and when you decide to end the contract:

  1. if what you have bought is faulty or misdescribed you may have a legal right to end the contract (or to get the product replaced or to get some or all of your money back) (see the section headed FAULTY / INCORRECT PRODUCTS);
  2. if you want to end the contract because of something we have done or have told you we are going to do (see below);
  3. if you have just changed your mind about the product. You may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions and you will have to pay the costs of return of any products (see the section headed RIGHT TO CHANGE YOUR MIND).

If you are ending a contract for a reason set out at (a) to (d) below the contract will end immediately and we will refund you in full for any products which have not been provided and you may also be entitled to compensation. The reasons are:

  1. we have told you about a change to the product which you do not agree to;
  2. we have told you about an error in the price or description of the product you have ordered and you do not wish to proceed;
  3. there is a risk that supply of the products may be significantly delayed because of events outside our control;
  4. you have a legal right to end the contract because of something we have done wrong.

RIGHT TO CHANGE YOUR MIND

For most products bought online you have a legal right to change your mind within 14 days after the date you receive the products and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in this section.

Please note that you do not have the right to change your mind in respect of products sealed for health protection or hygiene purposes, once these have been unsealed after you receive them.

If you choose to cancel the contract we will refund you any money (including delivery charges) which you have paid us for that product by the method you used for payment. However, we may make deductions from the price, as described below.

If you are exercising your right to change your mind:

  1. We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
  2. The maximum refund for any delivery costs applied will be the costs of delivery by the least expensive delivery method we offer.

We will make any refunds due to you as soon as possible. If you exercise your right to change your mind then your refund will be made within 14 days from the day on which we receive the product back from you or, if earlier, the day on which you provide us with evidence that you have sent the product back to us. Please note you must contact us before returning your package.
